A few days ago, a US-based Indian health company announced that they had filed a lawsuit against Pfizer for allegedly selling a counterfeit version of Viagra to consumers.
Pfizer, which had acquired the Viagra patent in 2002, is now pursuing $1.4bn of the global patent on the drug. The lawsuit alleges that Pfizer had used the counterfeit drug to make the brand-name medication Viagra.
The company is seeking to block a patent on the erectile dysfunction drug that has been in use since 1999.
The suit also charges that the drug was a “potentially ineffective medicine” that failed to meet the standards set by the US Food and Drug Administration.
The suit says that Pfizer had failed to adequately warn consumers of the dangers of the drug. It also alleges that Pfizer had not adequately warn patients of the risks.
Pfizer said it had received reports of adverse events linked to the drug’s use.
The case comes after a US District Court judge in New York ruled that the company had met its obligations under the patent and refused to take legal action against Pfizer, which claimed to have overstated the price of the drug.
Pfizer has also been ordered to stop selling the drug and to pay the US government a fine of $10m.
In August, a US judge ruled against Pfizer, saying that the company had met its obligations under the patent and that there was “no evidence of any inequitable conduct by the US government, and that the US government is responsible for the failure of the pharmaceutical industry to adequately warn consumers about the risks of the drug”.
